Terms and Conditions
1. Definitions
Account – When a customer registers with Blu Bangle at www.blubangle.com, a customer creates an Account.
Business Day – Monday through Friday each week, excluding U.K. public holidays.
Certificate of Posting - A Certificate of Posting is your proof that you have posted the item declared on the certificate into the Royal Mail network.
Distance Selling Regulations – the Consumer Protection (Distance Selling) Regulations 2000.
Downgrade – Changing a current Subscription to a Monthly Membership of a lower Gem value.
Gems – Blu Bangle’s online currency to show relative values of jewellery items and Subscription levels.
Jewellery Box – An online catalogue of a customer’s favourite Blu Bangle jewellery items.
Like-New – Lightly worn jewellery items.
Monthly Membership –A customer who has purchased a Subscription to borrow Blu Bangle jewellery on a month-to-month basis.
Outlet – Blu Bangle’s online sales venue of Like-New and new jewellery items.
Replacement Costs – The cost of replacing a lost or damaged item, determined by Blu Bangle. Consideration will be given to the retail value of the jewellery, how easy it is to replace and the number of occasions it has been rented, together with its condition.
Royal Mail First Class – A delivery service provided by Royal Mail that aims to deliver mail the next working day.
Subscriber – A customer who holds a Blu Bangle Subscription.
Subscription – A Monthly Membership or Weekly Visitor program.
Upgrade – Changing a current Subscription to a Monthly Membership of a higher Gem value.
Weekly Visitor – A customer who has purchased a Subscription to borrow Blu Bangle jewellery on a week-to-week basis.
2. Acceptance
BluBangle.com (“the Site”) and all its contents are the property of Blu Bangle Ltd (“Blu Bangle” or “We”) and usage of the Site is subject to the following Terms & Conditions of Use (“T&Cs”). By accessing the Site, you accept and consent to the practices described in the T&Cs. If you do not agree to the T&Cs, you should not access the Site at all.
3. Changes to Terms and Conditions
You are encouraged to read the T&Cs carefully and check back often as they may be updated from time to time. We reserve the right to amend the T&Cs at any time without notice.
We reserve the right to deny any online visitor access to all or any part of the Site for any reason whatsoever.
4. Registration - General
In order to take advantage of any Blu Bangle service, you must be registered with Blu Bangle. You can register with Blu Bangle at any time. Registration is free and does not require you to submit any payment details or to take advantage of any service. Once registered, you can create a personal Jewellery Box, add to or amend your Jewellery Box anytime, purchase products from Blu Bangle’s Outlet, and sign up for Blu Bangle’s newsletter service. Once registered, you are able to subscribe to a Monthly Membership or a Weekly Visitor program at any time. Registrations may be accepted, rejected or cancelled at any time at Blu Bangle’s discretion.
In order to register with Blu Bangle, you will be required to create a password. You are advised to keep this password strictly confidential. You are solely responsible for maintaining the confidentiality of this information, and you are solely responsible for any use or misuse of your registration with Blu Bangle. You must contact Blu Bangle immediately if you suspect unauthorised use of your Blu Bangle registration.
All information provided by you during the course of registration must be true, accurate, current and complete in all respects and you must agree not to impersonate any other person or entity or to use a false name. You should immediately notify us of any changes to your registration information, by either contacting Customer Service or by updating your personal details by accessing your Account online.
We encourage you to review Blu Bangle’s Privacy Statement to understand how we collect, store and use registration information. We are registered with the Information Commissioner’s Office.
5. Subscription - General
Blu Bangle offers two kinds of Subscription – Monthly Memberships and Weekly Visitor programs. Once registered, you can subscribe to a Monthly Membership or Weekly Visitor program at any time. Subscription is dependent on the confirmed payment of the relevant fees upon sign-up. Subscription entitles you to all the benefits of registration as well as, amongst other things, to rent products from Blu Bangle, and to receive promotional offers. Subscription applications may be accepted, rejected or cancelled at any time at Blu Bangle’s discretion.
6. Blu Bangle Subscription
To subscribe to a Monthly Membership or Weekly Visitor program, you must be resident in the U.K., (including Northern Ireland and the Channel Islands) and must be aged 18 or over and lawfully able to enter into contracts in accordance with English law. Subscribers must also have a method of payment acceptable to Blu Bangle.
Blu Bangle Subscriptions are not transferable and therefore cannot be sold, traded, used as security or legal charge.
7. Initial Term
There is no minimum or maximum subscription period for Monthly Members or Weekly Visitors.
8. Subscriptions – General
Monthly Members and Weekly Visitors choose a Subscription level when subscribing to Blu Bangle. Each Subscription level is attributed with a certain number of “Gems” as follows (subject to change):

Each item of jewellery on the Site is also priced with a number of Gems ranging from 1 Gem to 20 Gems (subject to change).
Jewellery Box - When you register with Blu Bangle, you can create your personal Jewellery Box online. You may put as many items in your Jewellery Box as you wish and can add and delete items at any time.
Monthly Membership Subscription - When you subscribe to a Monthly Membership, you will be prompted to prioritise the items in your Jewellery Box in the order in which you wish to receive them. We will then immediately ship jewellery items to you to the value of Gems attributed to your Monthly Membership subscription level. The items you receive will be those as prioritised in your Jewellery Box corresponding to the total number of Gems attributed to your Monthly Subscription level. Although we allow you to prioritise jewellery items the order in which you would like to receive them, we cannot guarantee you will always receive your items in the precise order you wish. Any unused Gems cannot be carried forward for use at a later time.
Weekly Visitor Subscription – when you subscribe to a Weekly Visitor program, you will be prompted to select those items from your Jewellery Box that you wish receive immediately. The appropriate Weekly Visitor subscription level should then be purchased. We will then immediately ship the jewellery items you selected to you.
9. Subscription Fees
By Subscribing to Blu Bangle, you agree to pay a fixed fee (“Subscription Fee”) each month for Monthly Members, and each week for Weekly Visitors (“Rental Period”). The amount of Subscription Fees payable depends on the type and level of Subscription purchased and are as follows:

Subscription Fees will be charged to your credit / debit card on the date your Monthly Membership or Weekly Visitor program is created, Upgraded or Downgraded and;
- For Monthly Members, each month thereafter on the calendar date corresponding to the commencement of your Monthly Membership, Upgrade or Downgrade until membership is cancelled. (Where the calendar date does not exist for a particular month, the last day of that month will be the relevant payment date); or
- For Weekly Visitors, the following week on the day corresponding to two business days after the commencement of your Visitor program, and every subsequent week on the same day of the week until cancelled. For example, if you subscribe as a Weekly Visitor on Monday, you will be billed upon Subscription and then the following Wednesday and every Wednesday thereafter until you cancel your Subscription.
Where a billing date falls on a non-business day, it may be charged on the next Business Day. Any other fees will be charged to your credit / debit card as you incur them.
We may, in our sole discretion, amend the Subscription Fees for any service at any time. We agree to notify you at least 30 days in advance of any change in Subscription Fees.
By Subscribing to Blu Bangle, you authorise the company (or a third party payment processing agent designated by Blu Bangle) to process charges to your payment card, in the instances of Subscription Fees, shipping fees (if relevant) and any damage/loss payments (see below). Authorisation to take payments will continue until you or Blu Bangle cancels your Subscription and all your obligations and liabilities have been satisfied.
Blu Bangle reserves the right to cancel or suspend your subscription for failure to use the service in a proper manner, non-payment of Subscription Fees or a breach of these T&Cs. In such instances, Blu Bangle will take necessary measures to reclaim any jewellery due for return, or reasonable replacement cost for jewellery due for return, and you will be liable for any expenses and costs incurred.
If Blu Bangle does not receive payment from your credit or debit card provider, your details are incomplete or inaccurate or if your credit or debit card expires or is rejected, notwithstanding our right to cancel or suspend your subscription, you agree to pay all amounts due upon demand. Blu Bangle reserves the right to take all steps necessary to collect amounts due from you, including but not limited to using third party collection agencies.
You are solely responsible for any and all fees charged to your credit or debit card by the issuer, bank, or financial institution including, related to any overdraft, insufficient funds, or over the credit limit fees. You will not hold us responsible for banking charges incurred due to Blu Bangle payments failing on your credit or debit card. You agree to notify us about any billing problems or discrepancies within 60 days after they first appear on your account statement. If you do not bring them to our attention within 60 days, you agree that you waive your right to dispute such problems or discrepancies.
Similarly, should Blu Bangle incur any costs for late payments, the company reserves the right to pass these expenses on to you for payment.
Value Added Taxes are included in all Blu Bangle Subscription Fees; you agree to pay these taxes as your responsibility.
10. Shipping and Handling Fees
Subscribers do not pay any additional amount for items shipped to them, or returned by them to Blu Bangle, provided all T&Cs are appropriately complied with, and Blu Bangle’s default delivery method is used. If you require your items delivered via next day special delivery, you will be charged £4.95 (subject to change) for the cost of this service.
Items purchased through the Blu Bangle Outlet will incur a separate shipping and handling fee of £2.00. We reserve the right to change the shipping and handling fees at any time.
11. Changing Subscriptions
Monthly Members may Upgrade or Downgrade to another Monthly Membership at any time.
Downgrade – you may request a Downgrade to your Membership by selecting this option in your Account or by contacting Customer Service. However, any reduction in your bill will only take effect when we receive your items currently on hand from you.
Upgrade - you may request an Upgrade to your Membership by selecting this option in your Account or by contacting Customer Service. We will immediately ship jewellery items corresponding to the increased Gem value of the Upgrade level. Any increase in your bill resulting from an Upgrade will take effect immediately. Immediately upon Upgrade you will be billed your new Membership Fee for the upcoming month, reduced by the relevant portion of your prior month’s Membership Fee already paid. The Upgraded Subscription Fee will then be due each monthly billing period thereafter.
Weekly Visitors cannot Upgrade or Downgrade an active Weekly Visitor program. Weekly Visitors cannot change their subscription to a Monthly Membership level of a lower Gem value. Weekly Visitors can, however, amend their Subscription to a Monthly Membership of an equal or higher Gem value at any time by selecting this option in your Account or by contacting Customer Service. We will effect your new Monthly Membership immediately upon amendment of your Subscription. Immediately upon conversion, you will be billed your new Membership Fee for the upcoming month, reduced by the portion of your Weekly Visitor Fee already paid. The new monthly Subscription Fee will then be due each monthly billing period thereafter.
12. Provision of Jewellery
All jewellery supplied to you by Blu Bangle is provided in new or Like-New condition.
Jewellery items that have been previously rented have been hygienically cleaned and earring posts / fishhooks have been sterilised. You are responsible for being aware if any materials cause you any kind of skin or other physical reaction. We cannot be held liable for any injury caused due to any reaction or ailment resulting from wearing products provided to you by Blu Bangle.
All jewellery remains the exclusive property of Blu Bangle at all times.
13. Delivery
Blu Bangle will notify you once jewellery has been sent to you. Items are delivered via Royal Mail Recorded First Class, unless you have made a request for a different delivery service (additional fees may be chargeable). Blu Bangle will not be held liable for any delays, loss or damage by Royal Mail and you agree to advise Blu Bangle of any delays or damage that occurred in transit.
We aim to deliver items to you within three business days. However, Blu Bangle cannot guarantee actual delivery time. Once the products you have ordered have been prepared for shipment, you will receive an email advising you of the delivery details. In any event, we will notify you immediately if we believe, for any reason, delivery time will exceed three business days.
14. Product Availability
For Monthly Members, we cannot guarantee that you will always receive items in the precise order as you have prioritised. If there is an item that you are relying on receiving in your next shipment, you should contact Customer Service to confirm availability.
15. Return Delivery to Blu Bangle
As a Subscriber, you can hold on to the jewellery for as long as you like, provided your Subscription remains current. When you are ready to return one or more items of jewellery, you should place jewellery items in the organza bags and boxes in which they were received, to ensure no damage in return transit. The box(es) should then be sealed in the enclosed return prepaid envelope.
To avoid problems that may arise with any goods lost in transit, you should return items at a Post Office with a Certificate of Posting to evidence return. Where Blu Bangle does not receive items returned by you, the Post Office Certificate of Posting will be requested as proof of delivery, otherwise the jewellery will be considered lost or stolen.
16. Cancellation
As a Monthly Member, you may cancel your Subscription at any time by calling Blu Bangle Customer Service. Your cancellation will only become effective once all jewellery items are returned to Blu Bangle. We reserve the right to charge Replacement Costs for any non-returned jewellery. Blu Bangle does not offer credits or refunds for any partial Monthly Membership period.
Weekly Visitor programs are cancelled once your items are returned to Blu Bangle.
17. Damage/Loss
By renting one or more items of jewellery from Blu Bangle, you agree to take reasonable care of the items and return them in good condition. You will not sell, rehire or modify jewellery belonging to Blu Bangle. Blu Bangle undertakes to deliver jewellery in good condition and expects to receive the same jewellery back in similar condition.
Should jewellery become damaged, lost or stolen, you agree to meet the Replacement Cost. Damage includes, but is not limited to, dents, bends, chips, tears and missing elements. Normal wear and tear does not constitute damage. Replacement Cost for jewellery is determined by Blu Bangle. Consideration will be given to the retail value of the jewellery, how easy it is to replace and the number of occasions it has been rented, together with its condition.
You accept full responsibility for jewellery stolen whilst in your possession, and you will have to pay the full Replacement Cost.
18. Purchasing Blu Bangle Jewellery
Blu Bangle offers Like-New and new items for purchase in its online Outlet. Monthly Members are entitled to a 10% discount of the sales price (subject to change).
VAT and a Shipping and Handling Fee (see above) will be added to the cost of the item(s) purchased.
19. Gift Certificates
Blu Bangle offers Blu Bangle gift certificates ("Gift Certificates") for purchase through the Site. Gift Certificates can be purchased in increments of £10. Gift Certificates are valid for activation within 12 months from the purchase date.
Blu Bangle allows recipients of Gift Certificates to redeem them through the Site. Recipients of Gift Certificates must be at least 18 years old, residents of the United Kingdom (including Northern Ireland and the Channel Islands) and will require a valid address and a debit/credit card acceptable to Blu Bangle. Gift Certificates must be redeemed in full at the time of redemption and can be applied against any Monthly Membership Program. Gift Certificates cannot be applied against Weekly Visitor programs or to purchase items through the Outlet.
Where a Gift Certificate is applied during the creation of a new Monthly Membership, Monthly Membership Fees will not be taken from the recipient's payment card during the Gift Certificate period provided the recipient does not Upgrade their Monthly Membership. If the recipient continues their Monthly Membership beyond the Gift Certificate period they will automatically be charged ongoing Monthly Membership Fees. The Monthly Membership can be cancelled at any time.
Where a Gift Certificate is applied to an existing Monthly Membership, Monthly Members Fees will continue to be credited to your debit/credit card, but you will receive an equivalent refund to your account of the relevant portion of the Gift Certificate value for that month, until the Gift Certificate period expires.
Gift certificates are not redeemable for cash, nor are they refundable or transferable. Gift certificates are subject to our standard T&Cs.
20. Dispute Resolution
If you have an issue with services received from Blu Bangle, we will do our utmost to address your concerns. You should first contact Blu Bangle Customer Service with any disputes you have. If the issue cannot be resolved to your satisfaction, Customer Service will escalate your dispute to a Blu Bangle Director to resolve with you.
21. Indemnity
You agree to indemnify Blu Bangle from any loss, liability, claim or demand made by any third party due to, or arising from, use of Bu Bangle’s services whereby these T&C have been breached.
22. Copyright and Trademarks
BLU BANGLE is a trademark of Blu Bangle. All Blu Bangle graphics, logos, page headers, button icons, scripts and service names are trademarks of Blu Bangle. All content and compilation thereof on the Site, including, but not limited to, text, graphics, logos, designs, photographs, button icons, images, data compilations, and software, is the property of Blu Bangle, and is protected by copyright laws. By accessing the Site, you acknowledge and agree that content included on the Site, including without limitation text, get up, graphics, logos, designs, photographs, images, and software, HTML and other code contained on the Site and all Blu Bangle copyright, designs, trademarks and other intellectual property and related materials, shall remain at all times vested in Blu Bangle. You agree and acknowledge that the materials are valuable property and that you shall not acquire any ownership rights in or to such materials. The material may not be used except as provided for in these T&C, without our written permission from Blu Bangle.
All trademarks, logos, images, product and company names displayed or referred to on this website are the property of their respective owners. Nothing on this website grants you any license or right to use, alter or remove such material.
23. Website Use
No part of the Site may be copied, reproduced, uploaded, transmitted or distributed without the express consent of Blu Bangle. You agree not to upload, post, email or otherwise send or transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, harm, damage, destroy or limit the functionality of any computer software or hardware or equipment linked directly or indirectly with the Site. You also agree not to interfere with the servers or networks underlying or connected to the Site or our services or to violate any of the procedures, policies or regulations of networks connected to the Site.
The Site is strictly for your personal and non-commercial use. You may not modify, copy, reproduce, distribute, transmit, publish, display, perform, license, create derivative works from, transfer, sell or otherwise commercially exploit all or any part of the Content or other software, products or services contained within the Site. You are strictly prohibited from using the Site or all or any part of the Content to further any commercial purpose, including, without limitation, any advertising or advertising revenue generation activity on any other website.
You agree not to impersonate any other person while using the Site, conduct yourself in an offensive manner while using the Site, or use the Site for any illegal, immoral or other harmful purpose.
24. Distance Selling
The Distance Selling Regulation does not apply to Blu Bangle, as amended.
25. Hyperlinks
Blu Bangle may from time to time include certain (hypertext) links on the BB Site which will lead to other websites or resources operated by third parties other than Blu Bangle, including advertisers. Blu Bangle has not reviewed all of the sites linked to the Site and will not at any time be responsible for the content or accuracy of any off-site pages nor for the availability of such external websites or resources. In particular, Blu Bangle is not responsible or liable, either directly or indirectly, for the privacy practices and/or the content of such websites, including without limitation any advertising, products or other materials or services on or available from such websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods or services available on such external websites or resources. The provision of a link is only for your convenience and information and does not imply an endorsement of any kind by Blu Bangle.
26. Withdrawal of Content
Blu Bangle reserves the right to, at any time and in their sole discretion, withdraw, temporarily or permanently, any content from the Site. Removal may be immediate and without notice. By accessing the Site, you agree that Blu Bangle is not liable to you or any third party for any such withdrawal.
27. Limitation of Liability
Blu Bangle will not be held liable for direct, consequential or indirect loss or damages of any kind suffered by Members as a result of any act or omission of Blu Bangle. This clause extends beyond the lifespan of any Subscription.
Blu Bangle cannot be held responsible for external companies' misrepresentation or malpractice.
We will not be liable to you for any lack of performance, or the unavailability or failure, of this website or our services, or for any failure by us to comply with these T&Cs, where such lack, unavailability or failure arises from any cause reasonably beyond our control.
28. Miscellaneous
A person who is not a party to these T&Cs shall have no right under the Contract (Rights of Third Parties) Act 1999 to enforce any term of these T&Cs but this shall not affect any right or remedy of a third party which exists or is available apart from that act.
29. Governing Law
The T&Cs shall be governed by and construed in accordance with the laws of England and each Site User irrevocably submits to the exclusive jurisdiction of the courts of England.
